    Directive 2012/29/EU, commonly known as the Victims’ Directive, establishes minimum rights to all victims of crimes and constitutes the core of the European Union’s legislative package aiming to guarantee that all victims of crimes have access to information, support and protection. Member States were required to transpose the Directive into national legislation but need to guarantee its correct implementation in practice as well. This implementation has proved to be complex and challenging. Hence, the present national report aims to assess the practical implementation of the Victims’ Directive in Spain.

  • Victims of Crime Implementation Analysis of Rights in Europe (VOCIARE): Slovenia

    Although the deadline for the implementation of the Directive 2012/29/EU (the Directive) was on 16 November 2015 Slovenia is still far from implementing it into its legal system. As the research has shown, implementation is fragmented, partial and insufficient, leaving different groups of victims with different rights and solutions. One of the problems is the unwillingness of the Ministry of Justice to regulate this area, and shifting responsibility to other actors. With the uncertain political situation (in June 2018, the National Assembly elections take place. Polls show the success of the Conservative Party, which has traditionally shown less interest in human rights) the future of the implementation is worrisome.

  • Victims of Crime Implementation Analysis of Rights in Europe (VOCIARE): Slovakia

    The aim of this research is to map the implementation of the Victims Directive in Slovakia, from the legislative, policy as well as practical perspective. Slovakia has adopted a comprehensive system of victim protection only recently. The law on victims (Act No. 274/2017 Coll. on Victims of Crimes, hereinafter also the “Victims Act”) was adopted on 12 October 2017 and came into effect on 1 January 2018. The experience with the new law is therefore very recent and this is reflected in the information gathered from the stakeholders and professionals during the research.

  • Victims of Crime Implementation Analysis of Rights in Europe (VOCIARE): Romania

    Directive 2012/29/EU establishing minimum standards on the rights, support and protection of victims of crime (the Victims’ Directive) is to date the most comprehensive binding legal tool to guarantee that all victims of crime in the European Union, regardless of their nationalities, are provided with the information, protection and support services they need. The Directive lays out concrete measures so that victims of crime and their relatives are treated in a non-discriminatory manner and based on an individual assessment of their needs, while also taking into account their wishes. The Directive radically changes the approach of many justice systems in Member States by placing victims and not offender at the centre of the criminal proceedings. Nevertheless, the transposition and practical implementation of the Directive are challenging and involve coordinated state and private efforts. The present report analyses the transposition and practical implementation of the Victims’ Directive in Romania, identifying gaps, challenges and good practices and issuing recommendations to competent authorities. Although Romania has, to a large extent, transposed the Directive into national legislation, several of its articles are still in draft form and have not yet been transposed. In addition, there are significant issues with the Directive’s practical implementation. This has led the European Commission to open an infringement case against Romania in January 2016.

    Directive 2012/29/EU, commonly known as the Victims’ Directive, establishes minimum rights to all victims of crimes and constitutes the core of the European Union’s legislative package aiming to guarantee that all victims of crimes have access to information, support and protection. Member States were required to transpose the Directive into national legislation but need to guarantee its correct implementation in practice as well. This implementation has proved to be complex and challenging. Hence, the present national report aims to assess the practical implementation of the Victims’ Directive in Portugal. After thorough assessment, it was possible to detect gaps and challenges in the practical implementation of the Directive.

  • Victims of Crime Implementation Analysis of Rights in Europe (VOCIARE): Poland

    This report, completed within the context of project VOCIARE, provides an overview of the practical implementation of the Victims' Rights Directive in Poland. The analysis of the individual provisions of the Directive and their comparison with the national regulations allows to conclude that the provisions of the Directive have been transposed into the national law and are applied in practice. Difficulties with the practical application of some provisions result not so much from the lack of implementation, but rather are the result of some infrastructural delays, or are related to the need to adapt the practice of conduct used for years to new conditions. There is no doubt, however, that the rights of victims of crime in Poland are respected in a more comprehensive and broader way than before the entry into force of the Directive 2012/29/EU.

  • Victims of Crime Implementation Analysis of Rights in Europe (VOCIARE): Malta

    This national report aims to assess the practical implementation of the Victims’ Rights Directive in Malta in the context of project VOCIARE- Victims of Crime Implementation Analysis of Rights in Europe. The project’s research methodology was created and adopted specifically for this purpose. The first two steps taken in order to develop this report were a legislative analysis and a mapping of competent authorities and organisations. In order to assess how the Victims’ Directive has been implemented in Malta, it was vital to know more about national legislation, to know how the Directive was transposed into national law in order to further analyse whether such legislation is being implemented, how and by whom. Mapping competent authorities and organisations was also essential to guarantee that detailed answers will be provided by the authorities, services and organisations which work in direct contact with victims.

Hence, the present national report aims to assess the practical implementation of the Victims’ Directive in the Grand Duchy of Luxembourg.

Member States were required to transpose the Directive into national legislation but need to guarantee its correct implementation in practice as well. This implementation is a task far from easy. This national research report aims to assess the success of practical implementation efforts in Lithuania.
