Agreement to terms and conditions

The following terms and conditions (“Agreement”) outline the rules and terms for the use of  VSE Intranet, and all its content and services available at or through the website (“Website”). The Website is owned and operated by Victim Support Europe (“The Organisation”). The Website is subject to your acceptance without modification of the terms and conditions contained herein.

Please read carefully this Agreement before accessing, browsing or using the Website. By accessing, browsing or using our Website or any part of it, you are agreeing to comply with it and to be legally bound by the following Agreement. If you do not agree to the terms and conditions of this Agreement, then you may not access the Website or use any services. 

We reserve the right, to make any changes or modifications to this Agreement at any time.  We will alert you about any changes or modifications by updating the “Last updated” date of this Agreement, and you waive any right to receive specific notice of each change. Your will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Agreement by your continued access, use or browsing of the Website after the date such revision or modification are posted.

Intellectual property rights

Unless it is expressly indicated otherwise, the Website, all source code, databases, functionality, software, website designs, audio, video, text, articles, photographs, and graphics on the Website (hereinafter, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by the Organisation or licensed to the Organisation, and are protected by copyright and trademark laws and various other intellectual property rights laws (the “Intellectual Property Laws”).

In using the Website and the Content, provided that you are eligible to use it, you acknowledge and agree to abide all applicable Intellectual Property Laws, as well as any specific notices contained on the Websites. All rights not expressly granted are reserved.

Prohibited activities

You may not access or use the Website for any purpose other than the one for which the Organisation makes it available. The Website may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by the Organisation.

As a user of the Website, you agree not to:

  1. Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive information such as user passwords;
  2. Circumvent, disable, or otherwise interfere with security-related features of the Website, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Website and/or the Content contained therein;
  3. Disparage, tarnish, or otherwise harm, in our opinion, the Organisation and/or the Website;
  4. Delete the copyright or other proprietary rights notice from any Content;
  5. Attempt to impersonate another user or person or use the username of another user;
  6. Copy or adapt the Website’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code;
  7. Make any unauthorised use of the Website, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretences;
  8. Make any unauthorised use of the information or personal data of victims shared on the Referral system of the Website. The use of such data, including names, email address, phone number, nationality, should only be used for the purpose of offering support and information to the victim.

User generated contributions

The Organisation will provide you (user) with the opportunity to create and submit content and materials to us or on the Website, including but not limited to text, writings, video, audio, photographs, graphics, suggestions, or personal information or other material (hereinafter, “Contributions”). Contributions may be viewable by other users of the Website. As such, any Contributions you transmit must be treated in accordance with the Organisation Privacy Policy. When you create or make available any Contributions, you thereby represent and warrant that:

  1. The creation, submission and the accessing, downloading, or copying of your Contributions do not and will not infringe proprietary rights, including but not limited to the copyright, patent, trademark, or moral rights of any third party;
  2. You are the creator and owner of or, you have the necessary licenses, rights, consents, and permissions to use and to authorise the Organisation, the Website, and other users to use your Contributions in any manner contemplated by the Website and this Agreement;
  3. You have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Website and this Agreement;
  4. Your Contributions are not false, inaccurate, or misleading;
  5. Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libellous, slanderous, or otherwise objectionable (as determined by us);
  6. Your Contributions do not ridicule, mock, intimidate, or abuse anyone;
  7. Your Contributions do not advocate the violent overthrow of any government or incite, encourage, or threaten physical harm against another;
  8. Your Contributions do not violate any applicable law, regulation, or rule;
  9. Your Contributions do not violate the privacy or publicity rights of any third party;
  10. Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of children;
  11. Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap;
  12. Your Contributions do not otherwise violate, or link to material that violates, any provision of this Agreement, or any applicable law or regulation.

Any use of the Website in violation of the foregoing violates this Agreement and may result in, among other things, termination or suspension of your rights(membership) to use the Website (see Breach of Terms and Conditions).

VSE Referral System

The Organisation will provide one username and one password per Member. The Member must indicate one element from their staff that will be responsible for the VSE Referral System.

When using the referral system users should:

  1. Only access if given legitimate access by the Organisation;
  2. Refrain to share special categories of personal data and duly comply with the Organisation Privacy Policy;
  3. Refer to the User Manual;
  4. Comply with the terms of this Agreement;
  5. Protect the integrity and privacy of the system.

Any violation of the foregoing violates this Agreement and may result in, among other things, termination or suspension of your rights(membership) to use the Website (see Breach of Terms and Conditions).

Site management

The Organisation reserves the right, but not the obligation, to:

  1. Monitor the Website for violations of this Agreement;
  2. Take appropriate legal action against anyone who, in our sole discretion, violates the law or this Agreement, including without limitation, reporting such user to law enforcement authorities;
  3. In our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable any of your Contributions or any portion thereof, if we consider that it may violate this Agreement;
  4. In our sole discretion and without limitation, notice, or liability, to remove from the Website or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems;
  5. Manage the Website in a manner designed to protect the Organisation rights and property and to facilitate its proper functioning.

Privacy policy

We respect and comply with the EU General Data Protection Regulations (GDPR). You can review our Privacy Policy here. By using the Website, you agree to be legally bound by our Privacy Policy, which is incorporated into this Agreement.   

Breach of terms and conditions

We will determine, at our absolute discretion, where there has been a breach these Terms and Conditions through your use of our Website. When a breach has occurred, we may take such action as we deem appropriate which may include all, or any, of the following actions:

  1. Immediate, temporary or permanent withdrawal of your right to use our Website;
  2. Immediate, temporary or permanent removal of any posting or material uploaded by you to our Website;
  3. Issue of a warning to you;
  4. Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
  5. Further legal action against you;
  6. Disclosure of such information to law enforcement authorities as we reasonably feel is necessary;
  7. We exclude liability for actions taken by us in response to breaches of these Terms and Conditions.

The responses described in these Terms and Conditions are not limited, and we may take any other action we reasonably deem appropriate.

In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

Applicable law

This Agreement shall be governed by and defined following the laws of Belgium. Any controversy, claim, or dispute arising out of or relating to the Agreement shall be subject to the exclusive jurisdiction of the competent courts of Belgium.
