European and International case law

In addition to the national legislation and the EU Victims’ Rights Directive, some victims’ rights are guaranteed by a number of international human rights instruments. In this section we aim to present some of the important elements of the international human rights case-law which is addressing different issues victims face in domestic proceedings, such as the right to life, right to a fair trial, access to court, but also the right to private and family life, freedom of religion or the prohibition of torture, inhuman and degrading treatment and punishment.

This section is, at present only looking into more recent case-law of the European Court of Human Rights, but as we advance we will aim to populate it with both with case-law of other international human rights bodies, such as the UN Committee for the Elimination of Discrimination against Women (CEDAW), UN Human Rights Committee (HRC) and other bodies, as well as historic cases which presented landmarks to victims’ rights from these institutions.
